General Terms and Conditions of Participation (GTC)

 

n the interest of ensuring a smooth and safe event, it is necessary to inform all participants and visitors of the following terms and conditions.


Please read these General Terms and Conditions of Participation (GTC) carefully, as they govern the contractual relationship between you and Erzbergrodeo GmbH.

The safety regulations and mountain rules apply without exception throughout the entire event area.


By registering, you expressly acknowledge and agree to these terms.

 

 

1. Scope

The general terms and conditions (GTC) described below apply to all participants (hereinafter referred to as “participants”) and visitors (hereinafter referred to as “visitors”) who participate in and/or visit an event organized by Erzbergrodeo GmbH. By participating in the event, participants agree to these terms and conditions. Any conflicting terms and conditions of the participant are expressly invalid.

The organizer is Erzbergrodeo GmbH, Haupstraße 13, A-2202 Enzersfeld.

 

2. Participation & Safety

Participants are required to read and accept the safety and technical regulations prior to registration.
Failure to comply with these regulations may endanger the event and/or other persons and will result in immediate exclusion of the participant without any right to refund.

The organizer will announce all organizational measures prior to the start of the event.
All instructions given by the organizer and its clearly identifiable personnel must be strictly followed.

Any violations that may disrupt the orderly conduct of the event or endanger the safety of the participant or others entitle the organizer to disqualify or remove the participant from the event area at any time without refund.

Participation and operation of vehicles within the event area are permitted only on designated tracks and areas, and only with vehicles that are registered and road-legal in Austria.

If a vehicle does not have road registration, the participant must present a valid inspection certificate under §57a KFG issued by a certified motor vehicle technician confirming its operational safety — excluding lighting systems, glazing, and attachments that may pose risks or be lost in off-road use.

The organizer reserves the right to carry out random inspections by certified vehicle technicians.
If a vehicle is found unsafe, it will be banned from operation on the event grounds and may only leave the premises by appropriate transport or tow truck.
All instructions from the organizer must be followed without exception.

Participants acknowledge that the event area consists almost entirely of unpaved off-road terrain.
Even with proper use, vehicle damage (e.g. paint scratches) is likely and accepted by the participant as a normal risk of participation.

Visitors must comply with all safety, event, fire protection, and administrative regulations, as well as any instructions issued by the organizer, property owner, or persons authorized to manage the premises.
Visitors may stay only within designated visitor areas and must not enter restricted zones.

Failure to comply with these rules or to follow the instructions of the organizer or security staff may endanger the event or other persons and will result in exclusion without refund of the ticket price.

Visitors may be denied entry if there is reasonable suspicion that they might disturb the event or harass others, or if they have violated rules or instructions at past events.
Persons obstructing ticket sales or attempting to resell tickets privately may be removed from the premises.

 

3. Registration / Terms of payment / Refunds / Organizational matters

 

Registration and Confirmation

 

Registration is completed exclusively via the online registration form.
Once the entry fee has been received, the registration becomes valid and the starting place is reserved.
After payment, each participant receives written confirmation of registration, including start number and additional event details.

 

Ticket Orders (Visitor and VIP Tickets)

 

All orders for visitor or VIP tickets — whether by phone, fax, or online booking — are binding.
Cancellation or withdrawal rights are expressly excluded, except where legally mandatory.

The organizer reserves the right to verify orders and to reject or limit them without stating reasons.
Shipping and credit card fees are billed separately. Purchased tickets cannot be exchanged or refunded.

Children under 14 years of age require no ticket.
Discounts may be granted at the organizer’s discretion but are not applied retroactively.

 

Scope of Services

 

The scope of services is defined exclusively in the valid event description or registration form. Any services not expressly listed are not included in the entry fee.

 

Withdrawal

 

The participant is entitled to withdraw from the contract and withdraw their entry. If the participant withdraws, the entry fee will be refunded minus a cancellation fee of 100 euros if they announce their withdrawal up to six weeks before the start of the event; after that, the entry fee will not be refunded. The declaration of withdrawal must be received by the organizer no later than six weeks before the start of the event. The withdrawal must be made in writing, either by registered letter, fax, or email, and will be confirmed in writing by email by the organizer and only then considered accepted. The organizer is entitled to offset the cancellation fee against any entry fees already paid. Any services not used by the participant on site cannot be refunded. It is expressly pointed out that the participant cannot transfer the contractual relationship (participation or starting place and start number) to another person.

 

Cancellation

 

The organizer reserves the right to postpone or cancel the race at any time before the start of the event for important reasons, or to change, restrict, interrupt, or cancel parts of the event. In the event of a postponement, the participant has the right to choose between a refund of the entry fee minus a handling fee of EUR 40 or participation in a possible alternative date. In the event of a cancellation, the entry fee will be refunded minus the handling fee. To this end, the participant must provide their bank details to office@erzbergrodeo.at within a period of four weeks. External services will not be refunded. In the event of a postponement, visitors have the option of requesting participation on a possible alternative date. In the event of a cancellation (even partial), the admission price will not be refunded. Any expenses incurred by the visitor cannot be claimed.

The organizer reserves the right to cancel, restrict, or terminate the event due to severe weather or unforeseeable events and influences that jeopardize the event. In this case, no refund will be made.

 

4. Disclaimer

In cases of force majeure, the organizer is entitled or, due to official orders or for safety reasons, obliged to make changes to the event or to cancel it. In such cases, the organizer shall not be liable for damages to participants or visitors.

Participants/visitors acknowledge that participation in motorsport events, especially in the mountains and in a quarry, involves considerable risks. It is the participant's responsibility to correctly assess their driving skills and physical condition and to have their health checked by a doctor beforehand. The organizer therefore accepts no liability for any health risks to the participant in connection with their participation in the event. The same applies to visitors during their visit. The organizer is not liable for personal injury, property damage, or financial loss. Participants are strongly advised to take out appropriate insurance, such as helicopter and rescue insurance, cancellation insurance, etc.

Participants take part in the event at their own risk. The same applies to visitors. In order to participate, participants must sign a declaration expressly acknowledging the organizer's exclusion of liability. This declaration will be sent to the participant together with the registration confirmation and must be signed by hand and handed in personally to the organizer at the race office by Thursday of the event at the latest. If the participant is not prepared to sign the declaration of liability exclusion, they must notify the organizer of this by registered letter within seven days of receiving the declaration. In this case, participation in the event is not possible.

If the participant fails to notify the organizer in good time or does not hand over the signed declaration of limitation of liability to the organizer by the start of the event, the participant will be excluded from participation. In this case, the participant will not be refunded any entry fees already paid.

The participant is liable for any property damage or personal injury caused by the participant in accordance with the statutory provisions; any liability on the part of Erzbergrodeo GmbH and its assistants is excluded in any case.

 

5. Covid-19 and other infectious diseases

Participation in the Erzbergrodeo is permitted only if the participant is in good physical health. Registered participants who have shown symptoms of infection with the coronavirus (SARS-CoV-2) or another infectious disease in the 14 days prior to the start of the event are not permitted to participate. The same applies to persons who have contracted Covid-19 or another infectious disease within this period and/or have had direct contact with a person infected with Covid-19 or another infectious disease. The same applies to visitors. The participant acknowledges that infection cannot be ruled out at events and accepts this risk of participation. The organizer and the persons acting on its behalf shall not be liable for any illness or its consequences. If health authority or legal measures are enacted that result in the complete or partial cancellation of the event, the participant has the right to choose between a refund of the entry fee minus a handling fee of EUR 40 or participation in a possible alternative date. If, for such reasons, the event is canceled within one week before the planned start of the event or if the event is terminated, the entry fees and/or admission prices paid will not be refunded.

 

6. Data collection and use

The personal data provided by the participant/visitor during registration will be stored and processed for the purposes of organizing and running the event. This also applies to the data required for payment processing. Further details can be found in the privacy policy of Erzbergrodeo GmbH, available on the website www.erzbergrodeo.at.

Insofar as it is necessary for the execution of the event, the stored personal data will be passed on to a commercial third party for the purpose of timekeeping, compiling the results lists, and publishing these lists. Insofar as this is absolutely necessary for participation, the participant agrees to the storage and transfer of data for this purpose upon registration.

The participant's surname, first name, year of birth, nationality, motorcycle brand, gender, team (if applicable), start number, and results (placement and times), as well as a photo of the participant, will be printed or published in any technically feasible form and made available for the purpose of displaying start and results lists in all relevant event-related media (printed materials such as newspapers and results lists, as well as on the Internet).

The participant/visitor agrees to the sending of information (including by electronic mail). This consent may be revoked at any time.

 

7. Film and photo rights

 

During the event, photos, TV or film recordings will be made, in which the participant/visitor may also be seen. Insofar as the image protection of § 78 UrhG (German Copyright Act) is concerned, the participant/visitor agrees that the photos, film recordings, and interviews of the participant made in connection with their participation in or visit to the event may be distributed, published, or used by the organizer in radio, television, print media, books, photomechanical reproductions (films, DVDs, etc.) by the organizer without claim to remuneration, free of charge, without restriction in terms of time and space, and also for advertising purposes, insofar as this does not conflict with legitimate interests pursuant to § 78 UrhG (nude photographs, drunkenness, criminal acts, etc.). The organizer is therefore granted the transferable right to take photographs and film during the event and on the event grounds and to use these recordings for the organizer's purposes or for general publication. In this context, the participant/visitor waives any objections based on industrial property rights, in particular copyright.

The participant/visitor may object to the recording, storage, and use of images for advertising purposes at any time. They may also revoke their consent to the use of their image for advertising purposes at any time. This can be done by email to the organizer or, ideally, directly to the photographers on site. Any further processing will then cease and the images will be deleted (unless further processing is necessary for the investigation and prosecution of criminal offenses).

The processing of any personal data contained in the photos, TV or film recordings is based on the (predominant) legitimate interest of the organizer in documenting the event and carrying out announcements and advertising measures. 8. General provisions

 

Participants/visitors are not permitted to make or have made films, photographs, drawings, or other images during the event, except for private purposes.

The operation of drones or aircraft, whether for commercial or private purposes, is prohibited.

The distribution or sale of goods, printed matter, food, or other items, as well as the provision of services of any kind, is only permitted with the prior written consent of the organizer. The use of brought-in machines and equipment is only permitted with the prior written consent of the organizer.

The invalidity or ineffectiveness of individual provisions of these General Terms and Conditions or the other event conditions does not affect the validity of the remaining provisions. The invalid or ineffective provision shall be replaced by one that most closely reflects the contractual intent.

Austrian law applies exclusively , excluding conflict-of-law rules. The place of jurisdiction is Vienna.
